NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

REQUEST FOR RELEASE OF FUNDS
On or after October 23, 2020 the City of Farmington Hills will submit a request to the U. S. Department of Housing and Urban Development for the release of Community Development Block Grant funds under Title I of the Housing and Community Development Act of 1974, as amended to undertake the following projects:
 
TIERED PROJECT TITLE:  Housing Rehabilitation Program
Tier 1 Broad Review:
Purpose: Improving existing single-family housing in Farmington Hills (city-wide) for low and moderate income residents. Located city-wide. The locations will be based on income qualifications required by HUD.
Level of Environmental Review Citation: Categorically excluded per 24 CFR 58.35(a) and subject to laws and authorities at 58.5.
 
Tier 2 Site Specific Review: The site specific reviews will cover the following laws and authorities not addressed in Tier 1 broad review:

  • Flood Insurance (Flood Disaster Protection Act of 1973 and National Flood Insurance Reform Act of 1994.
  • Floodplain Management (Executive Order 11988, particularly section 2(a), 24CFR Part 55
  • Historic Preservation (National Historic Preservation Act of 1966, particularly sections 106 & 100; 36CFR Part 800.
  • Noise Abatement and Control (Noise Control Act of 1972, as amended by the Quiet Communities Act of 1978; 24 CFR Part 51 Subpart B)
  • Environmental Justice (Executive Order 12898)
 
Estimated Project Cost: CDBG funding $225,546.00.
 
Mitigation Measures/Conditions/Permits (if any):  Each law and authority above will be applied to each address to determine if further consultation of the appropriate governmental agency is required or mitigation of any conditions prior to work.  
 
PUBLIC COMMENTS
Any individual, group or agency may submit written comments on the ERR to the City of Farmington Hills Community Development Office. All comments received by October 23, 2020 will be considered by the City of Farmington Hills Community Development Office prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
 
ENVIRONMENTAL CERTIFICATION
The City of Farmington Hills certifies to U. S. Department of Housing and Urban Development (HUD) that David Boyer, in his official capacity as City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. U.S. Department of Housing and Urban Development’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Farmington Hills to use Program funds.
 
 
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of funds and the City of Farmington Hills’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Farmington Hills; (b) the City of Farmington Hills has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR , Part 58, Sec. 58.76) and shall be addressed to U.S. Department of Housing and Urban Development – Detroit Field Office, Patrick V. McNamara Federal Building, 477 Michigan Avenue, Room 1685, Detroit, Michigan  48226-2592. Potential objectors should contact HUD to verify the actual last day of the objection period.
