The 47" District Court has jurisdiction over all landlord tenant actions arising from properties located within the City of Farmington or Farmington Hills. The 47'' District Court has Jurisdiction over summary proceedings for evictions In landlord tenant, land contract forfeitures, and evictions after the redemption period has ended after a mortgage foreclosure. 

I am a Landlord, How Do I start? 
Landlords who would like to evict a tenant will start by giving their tenant either a Demand for Possession or a Notice to Quit to Recover Possession of Property.

  • Demand for Possession
    • 7 day notice due to non-payment of rent that is owed. If tenant pays the rent that is owed or gives landlord possession of the property within 7 days of receiving notice, no further action can be taken.
  • Notice to Quit to Recover Possession of Property
    • Equivalent to one rental period (typically 30 days). Landlord wants possession of the property, regardless if payment of rent is made.

What will happen at my hearing?

  • Demand for Possession
    • A pretrial will be set at the earliest date available. At the pretrial, tenants are given information regarding eviction diversion programs and legal assistance programs. Parties are required to speak to each other privately, in hopes that a resolution can be met. If the case remains unresolved, a hearing will be set 7 days from the date of pretrial. The judge will have a hearing regarding the dispute, and the landlord can petition for a judgement.
  • Notice to Quit to Recover Possession of Property
    • A hearing will be set at the court's earliest available date. Parties are required to speak to each other privately, in hopes that a resolution can be met. If the case remains unresolved the judge will conduct a hearing a make a ruling.
